Welcome to Cal Climate Corp. By accessing or using our website at www.calclimate.com or engaging our HVAC services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our website or services.

These Terms govern your use of our website and general service policies. Individual HVAC service projects are governed by separate written service contracts as required by California law.

2. Description of Services

Cal Climate Corp provides residential and commercial heating, ventilation, and air conditioning (HVAC) services, including:

  • Air conditioning repair and installation
  • Heating and furnace repair and installation
  • HVAC system maintenance and tune-ups
  • System diagnostics
  • Commercial HVAC services and maintenance contracts

Our service area includes the Greater Los Angeles area, including the San Fernando Valley, San Gabriel Valley, and surrounding communities.

3. Service Contracts and Estimates

Online quotes and estimates provided through our website are preliminary estimates and are not final binding contracts. Final pricing may vary based on actual site conditions, equipment availability, and scope of work.

For home improvement work exceeding $500, a formal written contract will be provided before work begins, as required by California Business and Professions Code Section 7159. This written contract will include all legally required disclosures and supersedes any prior estimates.

Acceptance of an online quote constitutes your authorization for us to schedule a service visit. It does not constitute a final contract for the work described.

4. Online Quote System

We may provide quotes to you through unique secure links sent via email. Our online quote system operates as follows:

  • Each quote is sent via a unique, secure link accessible only to the intended recipient.
  • Accepting a quote online is valid under the California Uniform Electronic Transactions Act (UETA) and the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act).
  • Your acceptance is recorded with a timestamp and IP address for verification purposes.
  • A confirmation email is sent upon acceptance.
  • Each quote includes an expiration date. Quotes that have expired are no longer valid and a new quote must be requested.

5. Payment Terms

  • Payment terms will be agreed upon at the time of service.
  • All prices are quoted in US dollars.
  • Down payment limitations: Per California law, down payments for home improvement work cannot exceed $1,000 or 10% of the total contract price, whichever is less.
  • Progress payments: Any progress payments must be tied to specific work that has actually been completed.
  • Payment is due upon completion of service unless otherwise specified in your written service contract.

6. Cancellation Rights

Under California law (updated by Senate Bill 517, effective January 1, 2026), you have the following cancellation rights for home improvement contracts:

  • Standard contracts: You may cancel within 3 business days of signing.
  • Senior citizens (age 65 and older): You may cancel within 5 business days of signing.
  • Post-disaster repair contracts: You may cancel within 7 business days of signing.
  • Contracts signed at our place of business: The right to cancel does not apply to contracts negotiated and signed at our office.

Cancellation must be made in writing. Specific cancellation instructions will be provided with your written service contract as required by law.

7. Warranties

Manufacturer Warranties

Equipment we install is covered by the manufacturer’s warranty. Warranty terms vary by manufacturer and product. We will provide you with all applicable manufacturer warranty documentation at the time of installation.

Labor Warranty

We stand behind our workmanship. Specific labor warranty terms will be detailed in your written service contract.

Implied Warranty of Workmanship

Per California law, all work is performed in a reasonable workmanlike manner. This implied warranty cannot be waived for residential work under California law.

Warranty Limitations

Warranties do not cover damage resulting from:

  • Misuse, neglect, or lack of maintenance
  • Unauthorized modifications or repairs by others
  • Acts of God, including earthquakes, floods, and severe weather
  • Power surges or utility failures
  • Normal wear and tear

8. Limitation of Liability

To the maximum extent permitted by California law, Cal Climate Corp’s total liability for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

We are not liable for:

  • Pre-existing conditions of your HVAC system or property
  • Acts of God, including natural disasters and severe weather events
  • Utility interruptions or power failures
  • Discovery of hazardous materials (see Hazardous Materials section below)
  • Work performed by third parties
  • Indirect, incidental, or consequential damages

Nothing in these Terms limits our liability for personal injury or property damage caused by our negligence, or any other liability that cannot be excluded under California law.

9. Customer Responsibilities

To help us provide safe and effective service, you agree to:

  • Provide safe, reasonable access to HVAC equipment and work areas, including clearing a path and work space
  • Disclose any known hazards on your property, including the presence of asbestos, lead paint, mold, or other hazardous materials
  • Remove or secure personal property in and around work areas
  • Ensure that water, gas, and electrical utilities are accessible as needed
  • Follow post-service maintenance recommendations provided by our technicians to protect your equipment and warranty coverage
  • Be present or provide authorized access during scheduled service appointments

10. Hazardous Materials

If our technicians discover asbestos, lead, mold, or other hazardous materials during the course of work, we will:

  1. Stop work immediately in the affected area
  2. Notify you of the discovery
  3. Recommend that you engage a licensed hazardous materials specialist for assessment and remediation

Hazardous material remediation is not included in our standard HVAC services. Additional costs may apply if specialized handling or abatement is required before HVAC work can continue.

All refrigerant handling is performed in accordance with EPA regulations, including proper recovery, recycling, and disposal procedures.

11. Dispute Resolution

In the event of a dispute related to our services, we encourage the following resolution process:

  1. Direct communication: Contact us first. Many issues can be resolved through a conversation. Call us at (818) 843-5188 or email info@calclimate.com.
  2. Mediation: If direct communication does not resolve the issue, either party may request mediation with a mutually agreed-upon mediator.
  3. Arbitration: If mediation is unsuccessful, disputes may be resolved through binding arbitration. Per California Senate Bill 82 (effective January 1, 2026), arbitration is limited to disputes directly related to the services provided. Arbitration will take place in California, under California law, with full discovery rights as provided under Senate Bill 940.

Small claims court: Either party retains the right to bring a claim in small claims court for disputes within the court’s jurisdictional limits.

CSLB complaint rights: Nothing in these Terms limits your right to file a complaint with the California Contractors State License Board. You may reach the CSLB at 1-800-321-CSLB (1-800-321-2752) or www.cslb.ca.gov.

Neither party shall be liable for delays or failure to perform obligations caused by events beyond reasonable control, including but not limited to: natural disasters, earthquakes, fires, floods, pandemics, government actions or orders, utility failures, extreme weather conditions, supply chain disruptions, or equipment manufacturer delays.

15. General Provisions

  • Governing Law: These Terms are governed by the laws of the State of California.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Entire Agreement: These Terms, together with any written service contract, constitute the entire agreement between you and Cal Climate Corp regarding the subject matter herein.
  • Modifications: We may update these Terms from time to time. Continued use of our website after changes are posted constitutes your acceptance of the updated Terms. The “Last updated” date at the top of this page indicates when these Terms were last revised.
